Need advice about a DoLS application? HCC is here to help

Following recent discussions regarding the implications of the AGNI judgment and its impact on Deprivation of Liberty Safeguards (DoLS) applications, Hertfordshire County Council has provided reassurance that care providers should continue to submit applications where they believe a deprivation of liberty may be occurring. HCC has confirmed that applications are still being considered and prioritised in line with existing arrangements, and applications are not being rejected solely because of the AGNI judgment.

Providers are encouraged to seek advice if they are unsure whether an application is required. The Hertfordshire DoLS Team has emphasised its commitment to working collaboratively with care homes and supporting providers to understand evolving guidance, decision-making processes and assessment outcomes. Care homes should contact the team whenever they have concerns or require clarification. If in doubt, it is better to discuss the situation or submit an application for consideration.

The newly approved ADASS prioritisation tool is expected to be published shortly and will provide further support to managing authorities when making decisions about applications. HCPA will continue to share updates as national guidance and local processes develop.
