TERMS & CONDITIONS – ACE ‘Light Touch’ Mark Holder 2020/21
Throughout this Terms & Conditions policy:
‘HCPA‘ or ‘Us‘ refers to the Hertfordshire Care Providers Association.
‘Holders‘, ‘you‘, or ‘your‘ ‘refer to Staff Recruitment Agencies that supply staff to Adult Care Providers.
Terms & Conditions
Mark Holders Approval and Eligibility
Agencies must be providing, or intending to provide staff to Hertfordshire adult social care settings.
Agencies will submit the requested information to HCPA. HCPA will audit the information provided and accept or reject the application. Further information may be requested as part of the approval process. HCPA will review information provided against the requirements in a fair and honest way.
HCPA reserve the right to refuse application to the ACE Mark scheme and the ability to remove organisations from the scheme following any quality/safety breach or inappropriate behaviour of an ACE Mark Holder staff/worker. HCPA’s decision will be final.
If approved, HCPA will promote agencies that meet the ACE requirement via the HCPA website and other communication methods with HCPA members. HCPA will not be responsible for an agreement or contract between an ACE agency and the care provider. Care providers will be responsible for checking agency staff specific documentation in line with their regulatory and safety requirements and to meet the needs of their insurance.
ACE Mark Holders Limitations
HCPA does not in any setting or capacity, provide professional advice. The professional information is provided for general information and education purposes only and is not a substitute for professional advice.
Any information and training provided by HCPA is for general information purposes only and the information provided on the website, is given in good faith. HCPA makes no representation or warranty of any kind, express or implied, regarding the accuracy, adequacy, validity, reliability,
availability or completeness of any information provided through the term of your ACE Mark approval.
HCPA shall not have any liability to any ACE Mark Holder for any loss or damage of any kind incurred as a result of the use of our website, training courses or reliance on any information provided throughout the term of your ACE Mark Approval.
HCPA will not be responsible for the content or experiences third party learning providers may offer under training, informational guidance and ACE Mark Holders. The use and reliance of any information provided by third-party partners is solely at your own risk throughout the term of your ACE Mark Approval.
To the maximum extent permitted, the services performed and provided by HCPA and our partners, including benefits, are provided “as is” and “as available” with all faults and without warranty of any kind. HCPA reserves the right to make changes to the application, process and terms and conditions as and when deemed fit without the need or request consent prior or after changes have been made throughout the terms of your ACE Mark Approval.
No verbal or written information or advice given by HCPA and their partners shall create a warranty throughout the term of your ACE Mark Approval.
ACE Mark Holders may terminate their request for application and/or endorsement at any time. No refund of Mark Holders Fee will be available.
